As the end of 2025 draws closer, many of us in the condominium industry are thoughtful about the changes to the Condominium Act, 1998 which were passed by the Legislature in 2015. The fact that quite a few of the “new” provisions proposed under the amendments of to the Condominium Act, 1998 (the Act”) will expire at the end of 2025 is concerning. While I am not a fan of all the unproclaimed sections, I wonder why spend taxpayer resources, if the same were not going to be proclaimed. Was all that hard work for nothing?
Let’s take a step back.
The purpose of these changes was to affect a radical updating of the legislation governing condominiums in Ontario. Prior to this, the last time material changes were passed by the Legislature was in 1998, so updating the Act was well overdue and the need for modernization, reflection of lessons learned and looking to the future made sense. Accordingly, many years went into effecting the changes of 2015 prior to them being passed by the Legislature, including proposing the changes to the government, finding someone to listen and going through series of stakeholder discussions on what was important to stakeholders. In the condominium industry, this was a time-consuming and costly exercise for Ontarians. When you read it, you see the outcomes of the discussions and what matters to consumers. According, it may be prudent for the Government to proclaim into law, even if it is 10 years later, some of the changes before they disappear and waste the time and energy in those sections. By bringing those changes into law, consumers will be protected, specifically unit owners. Sections dealing with second opinions on reserve funds (a favourite of mine) would go a long way in effecting governance standards that prevent surprises on unsuspecting unit owners.
