The Underused Housing Tax Act came into force with an effective date of January 1, 2022. Any person or entity that owns residential property in Canada and that does not fall into the definition of “excluded owners” are considered to be an ”affected owner”. Affected owners must file an annual UHT return with the CRA by April 30, 2023 (a previous newsflash showed this date as May 1).

Reserve Fund Studies: What You Need to Know
The Condominium Act, 1998 requires that all condominiums have a reserve fund. The reserve fund is separate from the condominium’s operating fund, and it is used to pay for major repairs and replacements to the condominium’s common elements. By the same law, condominium corporations in Ontario must obtain a comprehensive reserve fund study report, which must then be updated every three years.

Some are easily dispelled – “all condominium units are small,” “condominiums aren’t for large families.” However, some go straight to the heart of condominium governance, including the misconception that the payment of condominium fees permits units to do whatever they want, or the misconception that the unit owners can do what they please within the four walls of their units.

“Water, water everywhere,” is not what you want to be thinking as you’re standing in the living room of a townhouse condominium unit or peering into the lobby of a high-rise. Water inside any attached housing structure means likely damage – furnishings and fixtures, floors and walls; it also means the possibility of rotting wood and mold risks; it means potential liability, and that something has gone terribly wrong.

Legislative Newsflash: Provisions for Electronic Meetings Extended to September 30, 2022
The Government of Ontario made regulatory amendments on October 1, 2021 under the Business Corporations Act (OBCA), Corporations Act (CA), Co-operative Corporations Act (CCA) and Condominium Act, 1998 (Condo Act) that extend the temporary legislative amendments permitting corporations governed under the OBCA, CA, CCA and Condo Act to call and hold meetings virtually, as applicable, notwithstanding current requirements.
